1/    Description of the service

 

The video.umontpellier.fr site is a hosting and broadcasting service for video or audio files produced by the University of Montpellier (UM). In the rest of this legal notice, the video and audio files will be called podcasts.

 

2/    Registration and access

Any UM staff and student with a university digital account will be able to access this service in authenticated mode. Only UM staff can deposit podcasts.
By default podcasts are visible on the Internet, users can restrict their visibility only to members of the UM (by authenticated access) or set up password access.

The contents are the responsibility of the person who deposited them on the platform (the depositor). The University of Montpellier declines all responsibility for these contents.
The user who filed a podcast is its responsible, either he owns the copyright, or he has the permission of the rights holder (s).

 

8/    Copyright and respect for intellectual property

This entire service is covered by French and international legislation on copyright and intellectual property. The podcasts available on the site video.umontpellier.fr are the exclusive property of their authors. Unless otherwise stated and subject to the legal exceptions of analysis and short quotation provided for in Article L.122-5 of the Intellectual Property Code, any representation or reproduction, in whole or in part, of a podcast without prior written consent of the author, constitutes a violation of the intellectual property rights liable to prosecution.
Consequently, the user may not reproduce, modify, repost, translate, commercially exploit or reuse in any way the content available on the video.umontpellier.fr service, without the prior written consent of the authors.

 

9/    Your user responsibility

By providing your content on the service (whether podcasts, comments you make), you are required to comply with legal and regulatory provisions. It is your responsibility to ensure that the storage and dissemination of this content via the service does not constitute (i) a violation of the intellectual property rights of third parties (ii) an offense against persons (including defamation, insults, etc.) and respect for private life, (iii) an offense against public order and morality (in particular, apology for crimes against humanity, incitement to racial hatred, child pornography, etc.).
By putting online and making available to other users your content on and / or through the service, you guarantee that you hold all the necessary rights and authorizations from the rights holders concerned and that you have fulfilled all the rights and payments due to the present to the collecting societies. Given the community nature of the service and respect for the sensibilities of each, it is up to the user to maintain a certain ethics as to the content of podcasts and / or comments posted online and, in particular, to refrain from broadcasting any violent or pornographic content.

Be sure to respect the image rights for published videos (videos of people, places, goods). Especially for podcasts showing minors, you must have written permission from their parents. It is prohibited to insert advertising or commercial content on its podcasts (automated or not). Be sure to respect the political, religious and commercial neutrality of the public service. Any author or rights holder undertakes to verify the veracity of the information published in the podcast.

 

10/    Video reporting

Anyone who notices a breach of image rights, ethical rules, etc., may request the removal of a podcast. This request must be formulated through the reporting icon on the podcast player and follow the legal procedures in force.

 

11/    Protection of privacy and personal data

As part of the distribution of podcasts, some personal data may be communicated to users of the platform. In accordance with the law "Computer and Freedoms" No. 78-17 of January 6, 1978 amended, the processing of your personal data has been declared to the Commission Nationale Informatique et Libertés (CNIL) .
